Oregon Loan Modification Laws

  2.  The State:
    • Requires a contract in writing with 24 hours for property owner to review before signing; Requires statutory format and writing to be in language of negotiation; requires contract to fully disclose property owner’s rights, terms, service, and compensation and property owners rights; Requires contract to be signed; Requires statutory notice of cancellation on first page with consultant’s contact information
    •  Prohibits waiver of rights, change of venue, choice of law and payment of cost clauses
    •  Provides for cancellation, rescission of contract at any time; Provides for civil remedies and describes unfair trade violations.
  3. Attorneys licensed in Oregon are exempt from regulation.
